NACD’s Vice President, Education & Member Programs, Michael Lang, received this certificate from the National Association of Safety Professionals in February 2020. This Safety Manager Certification indicates to employers, potential employers, regulatory agencies, and the courts that Mike has the knowledge, skills, and abilities equivalent to a level of proficiency expected of a safety leader. It shows Mike is capable of working with little or no supervision while managing the safety programs, policies, and procedures common to business and industry. Congratulations, Mike!
NACD played a key role in advocating and negotiating the July passage of S.4148, a long-term reauthorization of the Department of Homeland Security’s Chemical Facility Anti-Terrorism Standards (CFATS) program. The bipartisan legislation provided a clean 3-year extension of the CFATS program to July 27, 2023, and did not contain expanded information-sharing requirements for Chemical-terrorism Vulnerability Information or Site Security Plans beyond those with a need-to-know.
NACD submitted 85 comments of support on member petitions for 76 different chemicals as a part of the Miscellaneous Tariff Bill petition process. The International Trade Commission recommended 70 chemicals for inclusion in its final report, which will save thousands of dollars in tariffs for NACD members.
NACD strongly supported and participated in the Federal Motor Carrier Safety Administration’s final rule to increase the short-haul exception, allowing drivers to satisfy the 30-minute rest break requirement while “on-duty, not driving,” and extending the adverse driving conditions window.
NACD Vice President, Regulatory Affairs Jennifer Gibson was selected as Chair of the Surface Transportation Security Advisory Committee Emergency Management & Resiliency Subcommittee. She is leading efforts to produce a COVID-19 surface transportation after action/lessons learned report.
The Surface Transportation Board (STB) issued a final rule to require Class I railroads to include specific information on demurrage invoices and a final policy statement on the principles the STB would consider in evaluating the reasonableness of demurrage and accessorial charges. NACD commented in support of these measures.
NACD closely monitored and kept members informed on U.S. Environmental Protection Agency activities, including the final list of manufacturers responsible for payment of the first 20 chemicals undergoing TSCA risk evaluation. NACD also held a virtual workshop on TSCA Hot Topics and provided information through webinars and alerts on the 2020 Chemical Data Reporting requirements.
NACD worked with the Department of Homeland Security’s (DHS) Cyber and Infrastructure Security Agency (CISA) to secure the inclusion of chemical distribution, transportation, and warehousing in the Essential Critical Infrastructure Workers Guidance to ensure the industry’s continued operation despite stay-at-home orders and other restrictions.
NACD worked with DHS; the Food and Drug Administration; the Alcohol, Tobacco, Tax and Trade Bureau; and other associations to loosen certain restrictions and provide further clarity allowing for increased production. NACD also kept members informed of frequently changing guidance.
NACD worked with the Chemical Sector Coordinating Council and the Federal Emergency Management Agency to distribute cloth face masks to the NACD membership, keeping workers safe as they provided essential services to the COVID-19 response.
NACD helped secure the inclusion of the Paycheck Protection Program (PPP) in the Coronavirus Aid, Relief, and Economic Security (CARES) Act that established the PPP for small businesses to receive forgivable government loans during the shutdown. Further, NACD successfully advocated for the passage of the PPP Flexibility Act raising the non-payroll portion of a forgivable covered loan amount and extending the covered period.
NACD successfully helped secure 31 cosponsors in the Senate and 108 in the U.S. House of Representatives, to date, to promote the passage of the Paycheck Protection Small Business Forgiveness Act to provide full forgiveness for Paycheck Protection Program loans of $150,000 or less.
NACD produced a video promoting the importance of the chemical distribution industry in the fight against COVID-19.
