NACD COMMENTS ON DHS INTERIM FINAL RULE FOR CHEMICAL SECURITY
National Association of Chemical Distributors (NACD) President Christopher L. Jahn issued the following statement in response to the Interim Final Rule released today by the Department of Homeland Security to regulate high-risk chemical facilities.
“Our initial review of the Interim Final Rule indicates that the Department has developed a reasonable and well-thought-out plan to secure the nation’s chemical facilities. NACD is pleased that the Interim Final Rule recognizes the importance of tiering facilities based on risk and establishing performance standards for each tier. We also commend the Department’s balanced approach on the preemption issue, which clarifies that state laws in conflict with the federal rules will be preempted, while providing a consultation and review process where there is a difference of opinion.
“NACD urges Congress to recognize the effort that has gone into developing the new chemical security rule and to allow adequate time for it to be fully implemented and reviewed before changing the parameters.
“NACD and its members have always placed a high priority on the security of their facilities and products and demonstrate their commitment through their adherence to the Responsible Distribution ProcessSM (RDP). We look forward to continuing our partnership with the Department of Homeland Security in the coming months as the chemical security rule is implemented.”
NACD was the first chemical trade association to approve new security measures as part of its management program, the Responsible Distribution ProcessSM (RDP), and has developed a security vulnerability assessment that specifically addresses security issues relevant to chemical distribution facilities. NACD members have invested millions of dollars and substantial resources to safeguard their facilities and the transportation of their products.
