| Chemical Security Rule Updates |

The Department of Homeland Security (DHS) published the chemical security interim final rule in the Federal Register on April 9, 2007. The rule will take effect on June 9, 2007. Appendix A of the rule, which lists the chemicals and threshold quantities that triggers the requirement to complete the “Top Screen” assessment, is open for comment until May 9, 2007. DHS plans to finalize the list by the June 8 effective date. Based on the proposed list of chemicals and low threshold quantities, most, if not all, NACD members will be required to complete the Top Screen. NACD will submit comments on the list, raising concerns about the inclusion of chemicals that do not pose a security risk and the low threshold quantities. In addition, each company is encouraged to submit your own comments directly to DHS by following the instructions on the first page of the interim final rule. DHS is encouraging companies to register early for the on-line Chemical Security Assessment Tool (CSAT), which includes the Top Screen questionnaire, the Security Vulnerability Assessment (SVA) tool, and the Site Security Plan (SSP) template. Completed Top Screen questionnaires will be due 60 days following the rule's effective date. Go to www.DHS.gov/chemicalsecurity to learn more or to register.
DHS and the Chemical Sector Coordinating Council (CSCC) are holding a FREE Chemical Sector Security Summit June 11-13 in Falls Church, VA, just outside Washington, DC, that will be an excellent opportunity to learn about the new chemical security regulation. Among other topics, specific sessions will be held on Top Screen Training and on the new Chemical-terrorism Vulnerability Information (CVI) requirements. Because NACD is a CSCC participant, you, as a member of NACD, have first priority to register for the Summit. Priority registration ends TOMORROW, so please register right away. | TSA Considering Security Action Items for Motor Carriers |
| |
The Transportation Security Administration (TSA) has released a draft of voluntary security action items for the highway transportation of high security hazardous materials and security sensitive hazardous materials. The 27 security items are divided into four categories: 1) personnel security; 2) unauthorized access; 3) en-route security; and 4) other security measures. They include items such as background checks for motor vehicle HazMat employees other than motor vehicle drivers, locking doors on a tractor when unattended by a driver, establishing reporting procedures for suspicious incidents, threats, or concerns, and setting up a security hotline. While these action items will initially be voluntary, they could become the basis for a rulemaking later, as happened with the rail sector. | PHMSA Publishes NPRM on Cargo Tanks and Pressure Cylinders |

On April 12, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published in the Federal Register a notice of proposed rulemaking (NPRM) to revise certain requirements applicable to the manufacture, maintenance, and use of DOT specification cargo tank motor vehicles and cylinders and UN pressure receptacles. The NPRM is in response to numerous industry petitions. In the notice, PHMSA states that the proposed changes “are intended to enhance the safe transportation of hazardous materials in cargo tank motor vehicles and cylinders, clarify regulatory requirements, and reduce operating burdens on carriers, shippers, and users.” PHMSA will accept comments on the proposed revisions until June 11, 2007. | RDP Workshop Next Week - May 1-2 |

Although the registration deadline for the RDP Workshop has passed, NACD is still accepting late registrations. Whether your company is preparing for an upcoming RDP verification or you just need a refresher on the nuts & bolts of RDP, you will not want to miss this Workshop. Highlights of the Workshop will include small group discussions led by peers who have many years of RDP experience on how to implement RDP Policies and Procedures and practical insights into how to prepare for your on-site verification. The Workshop will be held at the Tremont Plaza Hotel in downtown Baltimore, MD. | Washington Fly-In – Record Participation This Year! |
| |
The NACD Washington Fly-In will take place May 15-16. To date 52 individuals have signed up for the program, making this the best-attended Fly-In in recent years. The program will feature a full day of meetings with Senators and Representatives on Capitol Hill as well as the opportunity to interact with high level officials from the agencies whose regulations most impact NACD members. DHS Assistant Secretary for Infrastructure Protection Robert Stephan will speak to participants on Tuesday, May 15 following the “Congress 101” briefing session. This will be very timely as the new chemical security interim final rule will take effect a few weeks after the Fly-In. In addition, a special meeting is confirmed with DOT Acting Deputy Secretary/PHMSA Administrator Thomas Barrett for 5 p.m. on Wednesday, May 16. This will be an excellent opportunity to discuss HazMat transportation security initiatives and to educate Deputy Secretary Barrett on how RDP promotes the safe and secure transportation of HazMat. | First State-Level You Be The Chemist Challenges to be Held in May |

In early May, two State You Be The Chemist (YBTC) Challenges will be implemented for the first time. The Illinois YBTC Challenge will be held on May 1 in Schaumburg, IL, and the Michigan YBTC Challenge will be held May 5 in Midland, MI. The YBTC Challenge is an academic competition that aims to engage grade 5-8 students in a dynamic event that partners members of the chemical industry with the schools and organizations in their community. Participants are quizzed on important chemistry concepts and discoveries, as well as chemical safety awareness.
State YBTC Challenges are held if more than two Regional YBTC Challenges exist within a state. The first, second, and third place winners from each Regional YBTC Challenge site move on to participate at the state level. In addition to individual prizes, the first and second place winners from each State YBTC Challenge also move on to the National YBTC Challenge, being held on June 15 at the Chemical Heritage Foundation (CHF) in Philadelphia, PA.
